Privacy Policy

Greening Point, Inc. ("Greening Point", "we", "us", "our", etc.) provides this website, email messaging, other electronic communication services, and related websites or services (individually or collectively, the "Service") for the use of registered individuals and/or the general public. This Privacy Policy (as amended from time to time) describes how we handle personal information that we may collect and retain.  In this Privacy Policy terms such as "you", "your", etc. refer to you as a user of any aspect of the Service.

We reserve the right, at our sole discretion, to change, modify, add, or delete portions of this Privacy Policy at any time without further notice. If we do this, we will post the changes to this Privacy Policy on the Service.  Your use of any aspect of the Service constitutes your acceptance of the Privacy Policy in effect at the time of your use.

Accountability and Security:  Greening Point is responsible for personal information under its control.  We comply with this Privacy Policy and with all applicable privacy laws.  We will protect personal information by reasonable security safeguards appropriate to the sensitivity of the information, consistent with generally accepted standards of commercial business practice.  When we use trusted third parties to act on our behalf by performing such functions as fulfilling orders, delivering packages, processing credit card payments or providing customer service, contractual or other appropriate means are used to ensure compliance by such third parties with this Privacy Policy.

External Services:  The Service contains links to sites operated by third parties that we feel may be of interest to our Service users, that may independently offer Greening Point products for sale, or where Greening Point has provided a portal or link to other services, including services where Greening Point is a sales agent or reseller ("External Services").  Examples include links to third party sites containing useful or interesting information, links to third-party sites that may offer Greening Point items for sale, links to discussion groups, blogs or social networks operated by third parties, and other services operated by third parties where our role was to conclude the sale of the service acting as a sales agent or authorized reseller. These External Services are independently operated and are not under the control of Greening Point.  The External Services operate according to their own policies.  Consistent with these External Service policies, Greening Point may receive information about sales of products, services or customer usage of the External Services.  We will use this information in accordance with our own Privacy Policy and we will also abide by any agreements we may have with the External Services regarding protection of information.  We encourage you to be aware when you leave our Service to read the privacy statements of each and every website that collects personally identifiable information.

Identifying Purposes:  Unless the purpose is self-evident due to the nature of the transaction in question, Greening Point will identify the purposes for which personal information is collected at or before the time the information is collected.  (An example of a self-evident purpose is requesting the name and address of the person placing an order in order to ensure proper delivery.)

Consent: We will collect, use or disclose your personal information only with your knowledge and consent, except where required or permitted by law.  Consent can be expressed or, in some circumstances, implied, and given in writing, by using or not using a check-off box, electronically, orally (in person or by telephone), or by your conduct, such as use of a product or service. Greening Point assumes your implied consent to share some personal information, such as your name or nickname, photo, environmental footprint rating, group memberships, and other profile-related information with other users unless you explicitly choose to hide this information.  In determining the type of consent to obtain, Greening Point will consider all relevant factors, including the sensitivity of the information and your reasonable expectations.  You may withdraw your consent at any time, on reasonable notice, subject to legal or contractual restrictions. Greening Point will inform you of the implications of doing so.

Limiting Collection:  The collection of personal information by Greening Point will be limited to what is necessary for the purposes which it identifies. We will collect personal information by fair and lawful means.

Limiting Use, Disclosure and Retention:  All personal information we collect will be used, disclosed and retained only in accordance with this Privacy Policy or as specifically stated at the point the information is collected.

Sale or Rental of Personal Information: We do not sell or rent customer lists or personal information to others. If we were to decide to sell or rent this information in the future, Greening Point would announce such a plan and ask you to “opt in”. If you wanted to share your personal information, you would have to respond. In the absence of such a response, your personal information would not be sold or rented to a third party. However, we may release your information to parties outside Greening Point in certain circumstances, which include:

(i) Disclosure with Your Consent:  On an ongoing basis, we will disclose your personal information to other organizations or individuals as requested by you. We release only the information required to identify you, as well as the specific data collected for which you have given consent.  It is important to understand the different ways that we may obtain your consent to collect, use, disclose and share your personal information. Depending on the situation and the sensitivity of the information, we may obtain your consent in different ways. Express consent may be obtained verbally, online or in writing. Implied consent may be obtained through your use of a product, or when you approach us to obtain products or services from us.

(ii) Disclosure for Servicing Purposes:  We give a limited amount of information, only as necessary, without your consent, to our suppliers and agents. To process and/or fulfill your transactions, trusted third parties may be used to perform the required function, and in such cases, appropriate personal information will be given to them to allow for the service to be provided. Contractual or other appropriate means will be used to ensure third party compliance with our privacy policy and all applicable privacy laws. These suppliers and agents may be located in the United States or other countries, and they in turn may disclose information in response to valid demands or requests from governments, regulators, courts and law enforcement authorities in their jurisdictions or countries.

(iii) Disclosure to External Services:  We may facilitate your access to an External Service and/or we may act as a sales agent or reseller for services provided by an External Service.  In such cases we will provide necessary information to enable such access.  The disclosed information will be governed by the privacy policy of the External Service.  In all such cases, you will have the opportunity to review such External Service's privacy policy prior to consenting to the disclosure.

Accuracy:  We will keep your personal information as accurate, complete and up-to-date as necessary for the purposes for which it is to be used.

Individual Access:  Upon request, Greening Point will inform you of the existence, use and disclosure of personal information we have relating to you, and give you access to that information. You have the right to challenge the accuracy and completeness of your information and have it amended as appropriate.  However, in certain circumstances this information will not be disclosed to you. Some examples of these circumstances are information that contains references to other individuals, that cannot be disclosed for legal, security or commercial proprietary reasons, or that is subject to attorney-client or litigation privilege.

Collection of Information from Children:  We do not knowingly collect or solicit personal information from anyone under the age of thirteen or knowingly allow such persons to register accounts with us. If you are under the age of thirteen, please do not attempt to register or send any information about yourself to us, including your name, address, telephone number, or email address. In the event that we learn that we have collected personal information from an individual under the age of thirteen, we will remove that information as quickly as possible. If you believe that we might have any information from or about a person under the age of thirteen, please contact us as specified below.  Certain services (for example, online discussion groups) and some External Services may impose additional age restrictions.  We do not collect financial information (e.g. credit card numbers) or similar information from anyone under the age of eighteen.

Types of Personal Information

The type of personal information which we collect from you depends on the type of transaction involved:

(i) Online:  Greening Point may ask for your name, address, email address, and other personal information when you create an account online. You may also be asked for personal information when you make an online purchase, subscribe to information alerts or news updates, or enter into contests or promotions. This information is used to process your transactions and to allow us to communicate with you. The information also enables Greening Point to customize products or services to better meet your preferences and to offer you products and services from Greening Point and other sources that may be of interest to you.

(ii) Profile:  When you create an account for use in the Service or any other Greening Point websites or software, you may be provided with the opportunity to create a user profile about yourself. Profile information may be presented back to and edited by you when you access the service; and in addition, may be presented to others who are permitted to view that information by your privacy settings.  Personal identifiable information will never be presented to others unless you have been given an option or choice as to  whether or not you want this information shared.

(iii) Discussion Groups, Comments and Other Submissions:  You may have the opportunity to participate in online discussions, comments, blogs, chat, inter-user messaging and other communication methods.  Any such information or post or submit on the Service at your own risk. You should generally assume that your submissions may be publically available to worldwide Internet users. Although we may allow you to set some privacy options that limit access to your submissions, please be aware that no security measures are perfect or impenetrable. We cannot control the actions of other users with whom you may choose to share your submissions and information. Therefore, we cannot and do not guarantee that submissions you post using the Service will not be viewed by unauthorized persons. We are not responsible for circumvention of any privacy settings or security measures contained on the Service. You understand and acknowledge that, even after removal, copies of submissions may remain viewable in cached, archived or indexed pages on the Service or on External Services, and others may have copied or stored your submissions during the time they were available.  Information you submit may be used by us as described in our Terms of Service.

(iv) Information Supplied About Others:  We may provide the opportunity for you to supply information to us about other individuals, for example an invitation service to tell a friend about our Service, products or services using your friend’s email address which you have supplied to us. At the time the information is collected we will describe exactly how it will be used.  Any contact such other individual will be strictly limited (typically a one-time email inviting him or her to visit the Service or try a product or service.) Greening Point stores this information to send this one-time email and to track the success of our referral program. The contacted individual will always have a means to request that we remove this information from our database.

(v) Information Incidental to Web, Email and Electronic Communications:  IP addresses, browser-supplied information and site session information (for example, the sequence of pages visited during a visit to the Service) may be recorded as part of the normal operation of the Service for purposes of usage analysis and security monitoring.  Tracking cookies (both session and persistent) may be used to implement certain features.  This will cause your browser to save certain information about your activities.  Most browsers can disable tracking cookies at the user's option, but this may limit your use of certain services.  Email messages contain information such as sender address and other "header" information (possibly including the sender's IP address, email client, name, organization, and other data).  In the ordinary course of processing email such information will be retained and available for as long as the email message itself is retained.  Normally we may retain copies of correspondence, including email correspondence, for indefinite periods.  Similar considerations apply to other forms of electronic messaging.

Use of Information without Identification:  Greening Point may use information your provide without identifying you as an individual to third parties. For example we may produce aggregated statistical reports of different geographic areas or we may personalize advertisements and promotions.

Removal of Personal Information:  The Service may provide tools to update, remove and/or control access to personal information. In addition, you may contact us as specified below to request account cancellation or information removal if the Service has not provided self-service tools.  In some cases due to technical and operational constraints we may require a reasonable time to remove material from the Service.  In all cases, removed material may persist in backup copies for an extended period, however such material will not longer be generally accessible to others.  Where you make use of the discussion or communication features of the Service to share information with other individuals (e.g., posting comments, sending messages) you generally cannot remove such communications

Unsubscribing from On-going Communications or Promotional Offers:  During your use of the Service you may subscribe to on-going information bulletins, news updates or similar.  Occasionally we send promotional offers to selected groups of Greening Point customers for offers from Greening Point itself, or for offers where we have joined with another business for such promotions. When we do this, we do not give that business your name and address. Such offers will always contain an unsubscribe option so you may indicate if you do not wish to receive any future offers. Please allow up to 7 business days for such request to be processed.

Necessary Communications:  If you are doing business with Greening Point or using the Service as a registered user, then even if you have opted-out of other subscriptions or promotional communications, we may use your contact information (including email) to communicate with you when this is necessary to complete requested transactions or facilitate your continued use of the Service.

Statistical Reports:  Greening Point may also use personal account information and data collected through your personal identification to generate statistics and aggregate reports for internal use and for sharing with affiliates, subsidiaries, licensees, successors and advertisers. These statistics and aggregate reports will not contain any information that could identify you personally.

Business Transfers:  As Greening Point continues to develop and grow, we may buy or sell parts of our businesses. A large portion of our businesses consist of the data collected by our software and websites, as well as our customer relationships, and personal customer information, which would generally be one of the transferred business assets.

Other Disclosures:  Notwithstanding anything else in this Privacy Policy, we will disclose personal information to law enforcement authorities, courts, government agencies or regulatory bodies as we deem necessary or as required by law.  We may disclose information to help us collect a debt owed to us by you. In the event of any situations that we reasonably believe may be a threat to the security of the Service, a threat to any of our other computer systems or networks, a threat to any Service users, or any public safety threat, we may use any and all information available to us to address such threats.

Limitation of Liability:  The use of the Service and related services are governed by our Terms of Service, including the LIMITATION OF LIABILITY which applies to any failure to conform to this Privacy Policy.
